REIMBURSEMENT FOR LOSS OR DAMAGE OF PERSONAL PROPERTY

USED BY THE SCHOOL DISTRICT

A.      Purpose and Scope

1.      To outline the district reimbursement limits and requirements pertaining to loss or damage of personal property in school district use

2.      To specify the procedure any individual must follow to gain such reimbursement

B.     General

1.      Suggestions or questions concerning this procedure should be directed to the designated administrative unit responsible (see section G).

2.      "Personal property" is any personal property other than apparel on the school premises for a general or specific school use.

3.      District reimbursement for loss or damage to such personal property will be made only when prior approval for its use has been given pursuant to Administrative Regulation 3532.12, "Temporary School Use of Personal Property", and only when such loss or damage occurs through no fault of the person providing the property.

4.      District reimbursement for loss or damage to personal property thus approved and in school use at the time of such an occurrence is in effect limited to a maximum of $90.00 or less per incident.

a.      Maximum reimbursement will be determined by reducing the total claim by either $10.00 or by the amount of recovery from all other sources including personal insurance, whichever is greater, up to the $90.00 limit.

b.      No insurance coverage is provided by the district carrier up to the first $5000.00 of any claim.

5.      The administrator approving the school use pursuant to Administrative Regulation 3532.12 is responsible for submission of any claim on behalf of the person providing the property.

6.      The Director of Business Services is responsible to act as the district claims representative/adjuster.

C.     Forms Used and Additional References

1.      The approved Request for Temporary Use of Personal Property on School Premises (Form BS/45/020)

2.      Burglary/Vandalism/Theft/Arson Report (Stock no. 20057)

D.     Procedure

1.      In the event that personal property damage or loss occurs as a result of apparent criminal action, the Burglary/Vandalism/ Theft/Arson Report is to be submitted per the form instructions contained therein and is to note personal property as such with the name of the person providing it clearly shown.

Note: Such personal property loss or damage should be reported along with any district property loss or damage for a given incident rather than on a separate form but with ownership indicated.

2.      The director of business services is to be notified immediately of damage or loss to personal property approved for school use in a written claim to be submitted as follows:

a.      The approved BS/45/020 form is to be referenced indicating its date, period of time authorized, and district facility authorizing use

b.      The location of loss

c.      Item(s) of personal property damaged or lost are to be shown

d.      A statement of nature of loss or damage is to be indicated, i.e., criminal or accidental

Indicate whether or not Burglary/Theft/Vandalism/Arson Report has been, or is to be submitted, including its date; and, if so, the criminal activities resulting in the damage or loss. (Attach copy when available.)

e.      Detailed description of damage or loss is to be made, including cost estimate

f.        Date and time when the damage or loss is to be made, including cost estimate

g.      Date and time when the damage or loss was discovered

h.      Whether or not police authorities were notified, and, if so, the date and time

i.         Whether or not there is any personal insurance coverage not previously indicated on the approved BS/45/020 form, or any other changes thereto

3.      The director of business services is to investigate the claim and prepare a recommendation for any required board actions.

4.      The person for whom the claim has been submitted is to be informed in writing of final board disposition of any such claim.

E.     Reports Required

1.      Burglary/Vandalism/Theft/Arson Report (see Section D.1)

2.      Written claim (see Section D.2)

3.      Recommendation for board action (see Section D.3)

4.      Letter of disposition (see Section D.4)

F.      Record Retention

Claim files will be retained by the Director of Business Services for a period of three years, microfilmed for subsequent retention, and then original file destroyed.
