PUPIL SUSPENSION

 

It is the goal of the Board of Education to provide a school learning environment conducive to providing the highest quality education for all students. In instances where the conduct of a student is such as to interfere with his/her own education or with that of other students, efforts shall be made by school staff to develop appropriate school behavior. These efforts should involve a progressive discipline process using student and parent conferences, detention, student study team interventions and/or referrals to school support staff.  When available means of correction fail to bring about proper conduct school officials may suspend the student from ongoing instruction for adjustment purposes in accordance with State law and administrative regulations.

A student may be suspended by the principal or his designee upon the first offense, if it is determined that: 1) the pupil violated subdivisions (a), (b), (c), (d), or (e) of Education Code Section 48900; 2) if the principal or superintendent determines that the pupil's presence causes a danger to persons or property; or, 3) if the principal or superintendent determines that the pupil's presence threatens to disrupt the instructional process or the peaceful conduct of school business.  It is the intent of the Board to provide for the fair and equitable treatment of students subject to suspension by affording them due process rights as provided by federal and state law.  Students with identified disabilities shall not be suspended from school for a period longer than 10 cumulative days in a school year without the appropriate involvement and intervention of the Individualized Education Planning team as prescribed in administrative regulations.

The Board of Education encourages the use of all available resources in the handling of disciplinary problems including the use of supervised in-house suspension programs for suspended students who pose no imminent danger or threat at school and for whom an expulsion action has not been initiated.  The Board also encourages the involvement of parents and guardians in the classroom behavior problems of their children. Teachers are, therefore, authorized, pursuant to Education Code 48900.1, to require that the parent or guardian of a pupil who has been suspended from the teacher's class for committing an obscene act or engaging in habitual profanity or for disrupting school activities or otherwise willfully defying the authority of a school employee, attend a portion of a school day in his or her child's classroom. Teachers who elect to impose this procedure shall do so in accordance with State law and administrative regulations.

It is the intent of the Board of Education that suspension shall not be imposed, directly or indirectly, against any pupil as a means of correcting truancy, tardiness, or other absenteeism.  Staff is further directed to provide all data on suspension and expulsion rates in a manner prescribed by the state.
