BOARD LEGAL STATUS

 

The Board of Education is the governing body of the Placentia-Yorba Linda Unified School District and derives its legal authority from the Constitution of the State of California, California statute, and the rules and regulations of the State Board of Education.

The Constitution of the State of California charges the Legislature with the responsibility of providing a common or public school system, further directs the Legislature to provide for a State Board of Education, and authorizes the Legislature to provide for school districts and their governing boards.

The California Education Code directs the State Board of Education to adopt rules and regulations not inconsistent with the laws of California for the governing of the public school system excluding certain institutions of higher education, and further directs that every school district shall be under the control of a board of trustees or a board of education.

The Board of Education of the Placentia-Yorba Linda Unified School District, on its own behalf, and on the behalf of the electors of the district, retains and reserves unto itself, without limitations, all powers, rights, authority, duties, and responsibilities conferred upon and vested in it. Although deemed a city board of education per the Education Code, the board is not constrained by any city charter since it is absent from any such provisions.
