STATUS CHANGE FOR MANAGEMENT EMPLOYEES

 

A.      Purpose and Scope

In the event it becomes necessary to release or reassign management employees to a position of lesser status and/or salary, the Placentia-Yorba Linda Unified School District will implement the procedure listed below.

B.     General

Changing administrative needs or district fiscal conditions will be accompanied by planned restructuring of management positions, salaries and/or work year. Reasonable employment procedures will be delineated to ensure fair treatment of management personnel.

Education Codes 44951, 44952 and 44949(d)

D.     Procedure

1.      Management personnel will be informed regarding pending release, reassignment or change in status or salary in the following manner:

a.      Notice of proposed action - 6 months prior to legal notification date, whenever possible

b.      Statement of specific reason

2.      Management personnel will have the opportunity to meet with the superintendent to discuss the reasons for the proposed action.

a.      Management personnel will have the opportunity to meet with the Board of Education, if necessary.

3.      Management personnel will have the following reassignment placement rights:

a.      Reassignment shall be suited to the experience, background and qualifications of the designated management employee.

b.      Primary preference over other applicants for a vacant position

c.      Opportunity to meet and confer with superintendent or designee regarding proposed placement

4.      Management will have the following post-decision rights:

a.      A written copy of the board's decision

b.      Right to reinstatement to management openings that occur during the first 24 months following demotion, subject to the following conditions:

1)      The position opening is at the same or lower management classification held at the time of reassignment.

2)      The employee has remained as an employee of the district.

3)      The employee has received satisfactory evaluation(s) in the interim.

4)      The employee meets the job specifications for the position.

5)      Superintendent recommends reinstatement to the Board based on the needs of the district.

5.      Management personnel will be provided the following types of assistance in obtaining alternative employment:

a.      Review and update of resume

b.      Job opportunity bulletins

c.      Assistance with job placement file service
