PUBLIC NOTICE - PERSONNEL NEGOTIATIONS

 

A.      Purpose and Scope

1.      The public should be informed of the issues that are being negotiated and have the opportunity to express their views on the issues to the Board of Education.

2.      The public should have the means of knowing the positions of their elected representatives, i.e. the Board of Education.

B.     General

Public Employment Relations Board (PERB) regulations require the district to make the initial proposal of the employee organization and the proposal of the district available for public input before bargaining actually begins.

C.     Forms and Additional References

1.      The district adheres to the requirements of public notice as set forth in Article 8, Section 3547 of Chapter 10.7 of the Government Code.

2.      A "Public Notice of New Negotiations Proposals" (Form PD l) should be posted at District Education Center within 24 hours of presentation to the Board of Education. (See no. 8 under Procedure.)

D.     Procedure

1.      A recognized exclusive representative association shall notify the superintendent in writing at least five (5) work days prior to a regularly scheduled meeting of the Board of Education that said association is prepared to present its initial proposal relating to the scope of representation as required by law.

2.      As secretary to the Board of Education, the superintendent shall receive the written initial proposal, shall make it matter of public record by inclusion in the minutes of the next regular meeting of the Board of Education, and shall make copies of said proposal available for public review at the District Education Center, all school sites, and at local libraries and city halls. In order to comply with this provision, the superintendent shall request that thirty (30) copies of the proposal(s) of the exclusive representative organization(s) be furnished the governing board at the time of public presentation. The superintendent, at his option, may require that duplicating costs be paid for by any other recipients who request copies. A representative of the association(s) shall be provided, upon written request, a place on the agenda to make an oral presentation regarding the initial proposal.

3.      The Board of Education shall at the next regular or called special meeting, and no sooner than seven (7) calendar days, provide the public with an opportunity to express itself regarding said initial proposal.

4.      The board shall then present the district's initial proposal at a regular or called special meeting open to the public and make copies available for public review at the District Education Center, all school sites, and local libraries and city halls. The superintendent, at his option, may require that duplicating costs be paid for by any other recipients who request copies.

5.      No sooner than seven (7) calendar days following the presentation of the district's initial proposal, the public shall be provided an opportunity to express itself regarding said proposal at a regular or called special meeting of the Board of Education. The board shall then, or at the next regular or called special meeting, adopt the district's initial proposal.

6.      Following the board adoption of the district's initial proposal, representatives of the board and exclusive representative association(s) shall begin meeting and negotiating.

7.      Within 24 hours of its presentation, the superintendent (as secretary to the Board of Education) shall make any new subject matter proposals within the scope of negotiations made by either party during meeting and negotiating available in printed form for public study and review at a known and designated place (or places) in the district.

8.      If a vote is taken by the Board of Education on any new subject of negotiations, the board shall make the roll call vote available as a matter of public record within 24 hours of the time of the vote (Form PD I - Personnel Division).

E.     Reports Required

Copies of negotiated employee contracts signed by the Board of Education and officers of the employee association(s) shall be mailed to the Public Employment Relations Board (PERB) by the district's chief negotiator.
