SCHOOL COMPETITIVE FOOD SALES

 

A.      Purpose and Scope

To establish a procedure for school competitive food sales

B.     General

Title V of the California School Administrative Code limits school competitive food sales to specific conditions for grades K-6 and secondary schools as outlined in the procedure below.

D.     Procedure

1.      Food Sales in Elementary Schools:

No school providing kindergarten or any of grades one through six shall permit the sale of food by any organization other than the district Food Service Department until after the regularly scheduled midday food service period or periods.

Only organizations consisting solely of pupils may be permitted to sell not more than one food item per sale providing that:

a.      These specific groupings of nutritious food items, approved by the governing board, are sold:

1)      Milk and dairy products, pure fruit and vegetable juices, fruits and vegetables, nuts, grain products, dessert items, soft drinks and bottled water.

2)      The food sale has been scheduled with the Supervisor of Food Services at least 48 hours prior to the sale.

3)      The sales during the regular school day are not of food items prepared on the premises.

4)      There are not more than four such sales per year per school

5)      The food item sold is not one sold in the food service program at that school

2.      Food Sales in High Schools and Middle Schools:

Only organizations consisting solely of pupils of Junior and Senior High Schools may be permitted to sell food items during the regular school day providing the following conditions are met:

a.      These specific groupings of nutritious food items, approved by the governing board to be sold:

1)      Milk and dairy products, pure fruit and vegetable juices, fruits and vegetables, nuts, and grain products, dessert items, soft drinks and bottled water.

2)      Any food sale which could affect the district food service program has been reported to the Supervisor of Food Services 48 hours in advance of the sale.

3)      Only one organization sells on a given day, selling no more than three types of food or beverage items and/or any one or more student organizations may conduct no more than four food sales of any food items during a school year in each school, but such sales shall be held on the same four days for any or all organizations.

4)      The sales during the regular school day are not of food prepared on the premises by the district food service program.

5)      The food items sold during the regular school day are not those sold by the district in the food service program at that school.
