COPYRIGHTED MATERIALS (GENERAL)

 

A.      Purpose and Scope

To outline the educational use requirements of the Copyright Act, P.L. 94-553, 90 Statute 2591, effective January 1, 1978

B.     General

The guidelines for book and periodical copying in public educational institutions shall be as follows:

1.      A teacher may make one copy for classroom instructional use of:

a.      A chapter from a book

b.      An article from a periodical or newspaper

c.      A short story, short essay, or short poem

d.      An illustration from a book or periodical

2.      A teacher may make multiple copies (one per pupil) for classroom use, provided:

a.      It includes notice of copyright (May be satisfied by writing "This material is copyrighted and not to be reproduced without the author's permission.")

b.      Meets the brevity requirements, as follows:

1)      Poetry of not more than 250 words, or two pages or less.

2)      Prose

a)      A completed work of not more than 2,500 words

b)      An excerpt of not more than 1,000 words or 10%, whichever is less, with a minimum of 500 words

c)      No more than one work or two excerpts may be copied from the same author, nor more than three excerpts may be copied from the same volume and no more than nine instances of copying per term

3)      One illustration per work

4)      Special works designed for children consisting of words and illustations which are less than 2,000 words, no more than 10% or two pages.

3.      Prohibitions

a.      Copying shall not be used to create or replace anthologies

b.      There shall be no copying of material commercially designed for classroom or student use specifically (i.e., consumable workbooks/test booklets).

c.      Copying shall not be:

1)      Substituted for purchase of literary goods

2)      Made of the same work from term to term (same teacher)

C.     Forms Used and Additional References

None

D.     Procedure

1.      No teacher or other employee may exceed or alter the guidelines set forth above in duplicating copyrighted materials. Individuals violating the District's copyright position do so at their own risk and assume all liability.

2.      Should questions arise, copies of the law will be available from the office of the Administrative Assistant.
