COPYRIGHTED MATERIALS (VIDEOS)

 

A.      Purpose and Scope

To outline the educational use requirements of the Copyright Act, P.L. 94-553, 90 Statute 2591, effective January 1, 1978

B.      General

1.       The guidelines for video tape copying in public educational institutions shall be as follows:

a.       Video Rentals

1)      Cannot be shown for recreational or entertainment purposes in the schools

2)      Can only be used as part of face-to-face teaching activities

3)      Cannot be transmitted through closed circuit systems without license

b.       Instructional Television:

1)      Legal use normally requires a contract with local ITV regional agency. If contracted:

a)       May be taped off-air for use in schools

b)       Most programs can be circulated and duplicated

c)       May be retained for classroom use for at least one year; most programs are renewed on a year-to-year basis

d)       Can be transmitted through closed circuit systems for instructional use

c.        Broadcast Television Programs:

1)      May be taped off-air by nonprofit educational institutions

2)      May be used only once within ten (10) consecutive days of broadcast for relevant teaching activities

3)      May be retained for a period of forty-five (45) days after date of recording for evaluation, but must be erased following the forty-five (45) day period

4)      Cannot be shown for recreation or entertainment

5)      Cannot be transmitted through closed circuit systems without a license

d.       Cable (Pay per View) Television:

1)      Fair use guidelines (Broadcast Television) do not apply.

2)      Cable television may not be used without permission from pay cable service.

2.       Satellite Transmission:

Use requires license from copyright holder

D.      Procedure

1.       No teacher or other employee may exceed or alter the guidelines set forth above in duplicating copyrighted material. Individuals violating the District's copyright position do so at their own risk and assume all liability.

2.       Should questions arise, copies of the law will be available from the office of the Administrative Assistant.
